Terms of Service
1. Introduction
Obelisk AI Ltd (“We”, “Us”, or “Our”) provides AI consulting and implementation services through its Consultation Package and Full-Service Package. These Terms of Service (“Terms”) govern the relationship between Obelisk AI Ltd and its customers (“You”, “Your”). By subscribing to our services, you agree to these Terms.

2. Services Provided
Consultation Package: Designed for businesses with direction in deploying AI & Automation into operations. Unlocking what’s possible by delivering strategic insights and empowering organisations by showcasing transformative impact.
Full-Service Package: Designed for businesses ready to deliver impact now, optimise performance, unlock growth potential, and scale effectively. Accelerating progress and success in today’s fast-paced business environment.

Packages that include UNLIMITED Requests, which are addressed one at a time.
3. Payment Terms
Payments can be made on a monthly or annual basis via Stripe
Customers may upgrade or downgrade between plans. If prorated adjustments are required, these will be calculated by default based on the remaining term.
Payments are processed via Stripe. In the event of a failed payment, Stripe will retry automatically according to its policies.
4. Cancellation and Termination
You may cancel your subscription with 30 days' notice.
Upon cancellation, services will continue until the end of the current billing cycle. Refunds for unused services will not be provided unless legally required.
5. Responsibilities
Customer Responsibilities: You must provide necessary data, access, and collaboration required for us to deliver services effectively. Failure to do so may result in delays or incomplete deliverables, for which we are not liable.
Provider Responsibilities: We commit to delivering services as described in your chosen package with reasonable care and skill.
6. Ownership and Intellectual Property
Customers retain ownership of all their data.
Obelisk AI Ltd retains ownership of the systems, frameworks, and modules it builds. Customers are granted a perpetual, non-exclusive licence to use these systems within their business operations.
7. Confidentiality
Both parties agree to maintain the confidentiality of any sensitive business information shared during the provision of services. Confidential information shall not be disclosed to third parties without prior written consent, except as required by law.
8. Disclaimers
We do not guarantee specific results or outcomes from our services. The success of implementation depends on various factors, including customer collaboration and market conditions.
While we strive for excellence, we disclaim liability for any indirect, incidental, or consequential damages arising from the use of our services.
9. Liability Limitations
Our liability is limited to the total amount paid for the subscription during the preceding 12 months.
We shall not be held liable for loss of revenue, profit, or data resulting from our services.
10. Force Majeure
We shall not be held liable for any failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, cyberattacks, or governmental restrictions.
11. Support and Response Times
Support is provided during business hours, Monday to Friday, 9:00 AM to 5:00 PM GMT. Response times may vary based on the complexity of the issue.
12. Data Security and Compliance
We comply with GDPR and other applicable data protection regulations. Customer data is processed and stored securely, and we take reasonable measures to protect against unauthorised access or breaches.
13. Termination by Provider
We reserve the right to terminate the agreement immediately if there is a breach of these Terms or misuse of our services.
14. Indemnity Clause
You agree to indemnify and hold harmless Obelisk AI Ltd from any claims, damages, or expenses arising from your use of our services in violation of these Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United Kingdom.
In the event of a dispute, both parties agree to attempt mediation before pursuing arbitration or court proceedings. Any disputes unresolved through mediation will be subject to arbitration under UK law.
16. Amendments to Terms
We reserve the right to update these Terms. Customers will be informed of any changes via email at least 30 days prior to the new Terms taking effect. Continued use of our services after the notification period constitutes acceptance of the updated Terms.
